What is a HAP shortfall?

October 2026 · Octopus Capital Group

If you rent to Housing Choice Voucher (Section 8) tenants, part of the rent comes from the housing authority. When the authority pays less than it owes, that gap is a HAP shortfall, and it often goes unnoticed.

How Section 8 rent is split

Under a Housing Assistance Payments (HAP) contract, the housing authority (PHA) pays its share of the rent directly to you, and the tenant pays the rest. The contract rent, the PHA’s share, and the tenant’s share are all set in writing and change when the tenant is recertified or the rent is adjusted.

For project-based Section 8, where the assistance is tied to the building, the HAP contract is with HUD, and payments come through HUD or its contract administrator instead of a local housing authority. The same kinds of shortfalls happen there, and they are recovered from HUD or the contract administrator.

Where shortfalls come from

How to find one

Compare, month by month, what the HAP contract says you should receive from the PHA with what was actually deposited. Line up the PHA’s payment register with your tenant ledger. Gaps that don’t match a documented abatement or contract change are worth investigating.

How to recover it

Housing authorities expect claims documented their way: the contract, the rent change approvals, the payment history, and a clear calculation. Submit the claim to the PHA, follow up, and use their dispute or appeal process if needed. Payments keep going to you as the owner on the contract.

One rule to remember

You can’t charge the tenant for the housing authority’s share. Federal rules limit what an owner may collect from a voucher tenant to the tenant’s own share of the rent, so the PHA’s portion has to be recovered from the housing authority or HUD.
